Against the backdrop of profound changes in the global supply chain and global economic integration, international trade and investment activities are becoming increasingly frequent, and cross-border commercial activities are also increasing. The cooperation and competition between enterprises cross national borders, forming a complex and diverse global business network, and the number of commercial disputes continues to increase. These disputes may involve multiple fields and often involve the legal systems, cultures, and business habits of different countries and regions. Promoting the development of cross-border commercial mediation cooperation has become an urgent need.
In order to focus on exploring the development path of cross-border commercial mediation cooperation, jointly discuss new trends and opportunities in commercial mediation, and promote the improvement and innovation of commercial mediation mechanisms, the "2024 Chinese Lawyer Conference (Special Event) - Exploring the Development Path of Cross border Commercial Mediation Cooperation" was successfully held at the Qianhai Fund Town Roadshow Center from 14:00 to 18:00 on October 22, 2024.
The event is hosted by the Overseas Chinese Affairs Office of the Shenzhen Municipal People's Government, the Taiwan Affairs Office of the Shenzhen Municipal People's Government, the Shenzhen Judicial Bureau, the Shenzhen Qianhai Shenzhen Hong Kong Modern Service Industry Cooperation Zone Management Bureau, the Shenzhen Federation of Returned Overseas Chinese, and the Shenzhen International Arbitration Court. It is organized by the Shenzhen Qianhai International Commercial Mediation Center and the Shenzhen Commercial Mediation Association, and is hosted by the Hong Kong Mediation Association, the Macau Bar Association, the Blue Ocean Legal Investigation and Commercial Mediation Center, the Hetao International Commercial Mediation Center, the Dongguan Mediation Association, the Huizhou Huirong International Commercial Mediation Center, the Zhongshan Law Firm Commercial Mediation Center, the Huashang Law Firm, the Beijing Deheheng (Shenzhen) Law Firm, the Beijing Guolian Zhengxin Technology Co., Ltd., the Shanghai Bizhi Technology Co., Ltd., and the Shenzhen Litigation Protection and Insurance. Technology Co., Ltd Co organized by the Commercial Mediation Legal Professional Committee of the Shenzhen Bar Association, lawyers, experts and scholars, corporate legal representatives, industry association representatives, and others from home and abroad gathered together.

Jiao Shoulin, the first level administrative director of the Legal Construction Division of Qianhai Administration, Li Leiming, the vice president of Shenzhen Commercial Mediation Association, and Du Chun, the president of Qianhai the Belt and Road Legal Service Federation, addressed the event.

Director Jiao Shoulin introduced the development of the Qianhai Shenzhen Hong Kong International Legal Zone from three aspects: construction background, target positioning, and work situation. He emphasized the need to improve the level of foreign-related rule of law through high-quality rules and create a legal business environment through high-level foreign-related rule of law.

Vice President Li Leiming introduced the development of institutionalized commercial mediation from the perspective of optimizing the internal and external environment of commercial mediation. He mentioned that from Singapore's legislative experience in commercial mediation in 2019 to the implementation of diversified mediation regulations in Shenzhen on May 1, 2022, the institutionalization of commercial mediation in Shenzhen has achieved a milestone leap, but still faces challenges.

President Du Chun stressed the importance of commercial mediation as a means of legalization in the context of the Great Bay Area and the the Belt and Road Initiative. He pointed out that although there is a gap between Shenzhen's commercial mediation and other regions such as Beijing and Shanghai, it highlights the enormous potential for development compared to highly developed mediation mechanisms abroad. As an important city in the Greater Bay Area, the development of commercial mediation in Shenzhen is not only related to the local economy, but also a key link in promoting the legalization process of the entire Greater Bay Area.

This roundtable discussion focuses on the field of commercial mediation, with representatives from commercial mediation institutions in different regions such as Hong Kong, Macau, Shenzhen, Dongguan, Huizhou, and Zhongshan participating in the discussion. During the meeting, representatives shared their work experience in the field of commercial mediation and the current development status of commercial mediation in their respective regions. They had in-depth exchanges on the development difficulties, opportunities, and future prospects of commercial mediation. The meeting pointed out that commercial mediation, as an important means of resolving commercial disputes, plays an important role in maintaining commercial relationships and promoting economic development. At the same time, representatives also discussed how to strengthen cooperation and jointly promote the professionalization and internationalization of commercial mediation. Through this meeting, all parties have enhanced their understanding and laid a solid foundation for future cooperation.

Based on this, representatives of mediation organizations in Hong Kong, Macau, Shenzhen, Dongguan, Huizhou, Zhongshan and other places jointly signed the "Cooperation Agreement on Promoting the Development of Cross border Commercial Mediation in the Greater Bay Area" to promote the development of the commercial mediation industry in the Greater Bay Area and the exchange and cooperation between commercial mediation organizations. The aim is to create a partnership and cooperation mechanism of mutual support, resource sharing, complementary advantages and common development through communication, interaction and cooperation among all parties, and work together to promote the revitalization and development of the commercial mediation industry in the Greater Bay Area.

In the context of profound changes in the global supply chain and economic integration, the 2024 Chinese Lawyers Conference focuses on exploring the development path of cross-border commercial mediation cooperation.
